Jo Haylen moves that this House:

  1. Notes that the Government has issued letters to residents in Haberfield and along the corridor for the proposed M4 East Tunnel notifying of their intention to acquire sub-surface property without compensation.
  2. Notes that while this is permitted by the Land Acquisition (Just Terms Compensation) Act 1991, property owners in other states and jurisdictions are duly compensated for sub-surface acquisitions.
  3. Considers that, by comparison, New South Wales residents are disadvantaged.
  4. Calls on the Government to change the Land Acquisition (Just Terms Compensation) Act 1991 to allow for New South Wales residents to be fairly compensated for compulsory sub-surface acquisition.
